Terms of Service

1. Acceptance of Terms

By accessing or using the Matchly platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. User Roles

Matchly provides two types of accounts: BCBA Professional accounts and Company accounts. BCBA accounts are free and allow professionals to create profiles and connect with companies. Company accounts require a paid subscription and provide access to the full candidate pool and matching features.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate another person or misrepresent your qualifications, certifications, or professional credentials
• Transmit any malicious code, viruses, or other harmful content
• Attempt to gain unauthorized access to other user accounts or platform systems
• Scrape, harvest, or collect user information without consent
• Use the Service to spam, harass, or send unsolicited communications

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Matchly and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Matchly.

6. User Content

You retain ownership of any content you submit to the Service, including profile information, bios, and messages. By submitting content, you grant Matchly a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and providing the Service.

7. Payment Terms

Company accounts are billed on a monthly or annual basis as selected at the time of subscription. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice to existing subscribers.

8. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Matchly does not guarantee any specific outcomes from using the Service, including but not limited to employment placements or hiring results. We do not verify the credentials, background, or qualifications of users beyond the information they provide.

9. Limitation of Liability

In no event shall Matchly, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time by contacting us.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
